Suggested Changes to SB765

After tracking the draft amendment from LRB against the agreed to language, we found a number of issues that need to be addressed before the next amendment is filed. For the purposes of this email, I will be working from the LRB draft version that contains their added language on page 10, lines 12 & 13, and all page and line references will refer to that document.


Language Changes

1.) page 8, lines 12 & 13, under Section 53 (a) (B), now reads: '(i) an amount no greater than the weighted average rate by geographic area grouping of the individual's qualified residence and (ii) an amount no greater than the licensure category of the facility in which they received care reduced by the average capital component of the overall facility rate.'

The purpose of the formula being described here was to set up a rate of reimbursement for the individual based from the combined nursing and support rate they would have received in a facility setting in that geographic area that they would be moving into to now receive home and community based long-term care services.

This language was meant to reference the setting that the individual was moving from. As drafted, this is trying to establish a rate based on the settings the individual would be moving into. You cannot set the rate from the geographic grouping area of a qualified residence as they have no such thing. This would necessitate change in part (i).

To further this, in discussion, we have determined that there is a simpler way altogether to tackle the formula we created to capture the rate based on the licensure of the facility based on geographic grouping area and excluding the capital rate reimbursed to the facility.

The following would capture the intent of the formula and all its parts in a cleaner fashion, and so we suggest making the following change;

Striking parts (i) and (ii) under (B) and replacing them as follows:

(i) an amount no greater than the licensure category of the facility in which they received care reduced by the average capital component of the overall facility rate and (ii) further qualified by the weighted average rate by geographic area grouping that a facility of the same licensure category would receive in the area of the individuals qualified residence.

2.) page 10, line 12, under Section 53, immediately after the word 'disabilities', strike the words 'and people aged 60 or older' AND THEN insert the following immediately after the word 'disabilities', 'under age 60, and persons with disabilities age 60 or older'

3.) page 12, line 7, under Section 55, immediately after the word disabilities, insert the following, 'under age 60, or persons with disabilities age 60 or older'

4.) page 12, line 12, under Section 55, LRB truncated a sentence to read: 'The Departments shall work together with organizations comprised of, or representing people with disabilities or people age 60 and older and providers of Medicaid acute and long-term care services, to ensure that persons with disabilities, and their families, guardians, and advocates are informed of their rights under this Act in a manner that is easily understandable and accessible to people with disabilities.'

The agreed to language read as follows: 'The Departments shall work together with organizations comprised of, or representing people with disabilities or people age 60 and older and providers of Medicaid acute and long-term care services, to ensure that persons with disabilities, and their families, guardians, and advocates are informed of their rights under this Act in a manner that is easily understandable and accessible to people with disabilities and their families, guardians, and advocates.'

My assumption is that the Bureau found the language at the end of this sentence to be redundant and therefore unnecessary. However, it is indeed a very necessary part of the sentence. Some persons with a disability will not have the ability to access and understand the information being provided under the Act, and the inclusion of their families, guardians, and advocates becomes very important in those instances.

This language should be re-inserted at the end of this line.

Grammatical Changes

5.) page 4, line 14, under Section 52, the word individual in "Eligible Individual" does not need to be capitalized.

6.) page 5, line 21, under Section 52, immediately after "Interdisciplinary team", should be inserted the following: '. The term interdisciplinary team'

7.) page 6, lines 2 & 3, in Section 52, under the definition of "Interdisciplinary Team" LRB removed capitalization of the term 'Qualified Mental Retardation Professional'. This is a professional designation, and as such, should remain capitalized, as in the agreed to language.

8.) page 7, line 6, in Section 52, under the definition of "Self-directed Services", part (b), LRB removed commas creating the following opening to that section: 'Individual service care or treatment plan:'. This should be changed to read, 'Individual service, care, or treatment plan', as the meaning is changed by removal of the commas. Additionally, re-inserting the commas would make this section track with the language in the rest of the legislation.

9.) page 7, line 8, under Section 52, immediately after the word representative strike the comma

10.) page 7, line 13, under Section 52, immediately after 'directing;' add the word 'and'

11.) page 7, line 21, under Section 52, immediately after the word 'Services; strike the comma

12.) page 8, line 19, under Section 53, insert a comma immediately after the word 'managers' and insert a comma immediately after the word 'annually'

13.) page 11, line 9, under Section 53, immediately after the word 'service', insert the following, ',care,'. This addition is necessary to make the language track throughout the bill.

well my equine friend, that was certainly not what i was trying to do.

i would say that my...i mean, THIS post required FAR more effort than the others. obviously this poster had to pore over a 20 page piece of legislation checking every punctuation mark and capitalization to ensure that only the best law is passed in Illinois to ensure that the disabled have good quality services offered to them.

i'd say that took more effort than finding a photo of ron jeremy or a tampon, wouldn't you?
