Student charged for writing violent essay
High school senior says he was just following the assignment

CARY, Ill. - Authorities have filed a second disorderly conduct charge against a high school senior arrested for writing an essay officials described as disturbing and inappropriate.
Allen Lee, 18, of Cary was arrested earlier this week after penning the essay at his northern Illinois high school. Lee contends he was just following the creative writing assignment he was given in class at Cary-Grove High School.
Lee initially faced just one charge, but an amended complaint filed Thursday cited a second passage.
According to the complaint, the essay reads, in part, "Blood, sex and booze. Drugs, drugs, drugs are fun. Stab, stab, stab, stab, stab, s...t...a...b...puke. So I had this dream last night where I went into a building, pulled out two P90s and started shooting everyone, then had sex with the dead bodies. Well, not really, but it would be funny if I did."
Another passage said, "as a teacher, don't be surprised on inspiring the first CG shooting," the complaint said.
The creative writing assignment in Lee's English class on Monday instructed students to "write whatever comes to your mind. Do not judge or censor what you are writing," according to a copy of the assignment.
"In creative writing, you're told to exaggerate," Lee said. "It was supposed to be just junk. ... There definitely is violent content, but they're taking it out of context and making it something it isn't."
Lee has been removed from school, and District 155 spokesman Jeff Puma said the district is evaluating Lee's punishment while he attends an offsite learning program in the school district.
"It wasn't just violent or foul language," Puma said. "It went beyond that."
Lee's attorney, Dane Loizzo, said his client was within the parameters of the assignment.
"A stream of consciousness seems to be the goal of the assignment," Loizzo said. He said Lee has never been disciplined in school and signed Marine enlistment papers last week.
His father, Albert Lee, has defended his son as a straight-A student who was just following instructions and contends the school overreacted. However, Albert Lee has said he understands the situation because of what happened last week at Virginia Tech when student Seung-Hui Cho killed 32 students and faculty members before committing suicide.
The charges against Lee could result in a possible $1,500 fine and up to 30 days in jail if he is convicted.
Cary is about 40 miles west of Chicago.

What the fuck?! $1500 and 30 days in jail because the kid wrote some "disturbing" stuff? That's a bit much, don't you think? Besides, from the excerpts it sounds like half the people on this site shit more "disturbing" things than that kid wrote.
What about freedom of speech? Aren't we allowed to say/write whatever we want, as long as it doesn't harm the public, without fear of prosecution? I think that's supposed to be protected in that Bill of something or other.
"Relax" you say. He's a high school kid. Kids aren't protected under the bill of rights, that's why we can subject them to curfews, search and seizure without a warrant, etc. If some kid gets in trouble for an essay, that doesn't affect precedent for me.
But notice he's 18. This is an adult being charged over something he wrote. Sure it may have been a bit weird, but Jesus, this isn't Iran!

Even the kid's dad, while supporting his son, mentioned he "understands the situation" with regard to VT. What's to understand?! Your kid is a straight A student with no history of violence, yet he should be prosecuted over what he wrote because of a maladjusted Korean living in Virginia?!

I am not sure if this was addressed int he responses, but isn't Freedom of speech limited in certain institutions?
I work for a large tech company (HAL), but am I allowed to say anything I want? No, I think that when you agree to take a position with a company you agree to a certain degree of restriction of your speech and behavior.
I believe the same is true with public schools. Freedom of speech is restricted, not to squash a citizens right to expression, but to ensure the environment is safe for all who attend the same school.
I am unsure where I heard these examples. The bottom line ended up being: The constitution says the GOVERNMENT may not infringe on your rights, but private companies are free to do what they want. If you do not like the company policy, you are free to find another that suits your personal beliefs and need to express yourself (Or sue them if you want to force them to allow you to express yourself in words/actions that they find unaceptable.
Public schools do not fit that model, but are a gray-area since they are part of a local governmet but are dealing with large groups in which safety is the most important concern.
Any constituional scholars out there that can set me straight? I am confused as to what a school or private business may allow/deny as far as rights go.

Funny thing about that. It appears that free speech lost out to profit. The publisher stopped printing the book and pulled copies from stores due to the lawsuit (course that suit against them was brought on by the relatives of the murdered individual, not the government). However, that book is now available free online at http://ftp.die.net/mirror/hitman/
So I'm not sure any more. With the internet nowadays, maybe free speech always comes out on top, in the end.

There was no mention of him directing the letter at his school in that article, either.. He said it would have been cool to shoot up a building and have sex with the bodies. He said nothing about a school or students in particular.

Let's say the kid went on a killing spree. The school --having not acted out of respect for free speech-- would be sodomized by the media and the courts; something the kid should have been well aware of. If he was so bright, and a straight-A student, and hadn't lived under a rock for the past decade, he should have known how an essay about killing and raping his fellow students would go over in a post 9/11, post Columbine, post VT world. The only conclusion is that the kid was looking for attention, which is exactly what he got. I'm actually impressed that the father said he understood why his kid was in hot water, rather than pulling off the customary "MY CHILD IS JUST DIFFERENT! That's overstepping their bounds and its definitely walking all over his rights as a citizen of the united states. They could have acted, however they had NO right to act the way they did.

Yes and no. We have freedom of speech in this country. Was the kid just looking for attention? Probably. Should the school have "investigated" him and subjected him to school-counciling? Sure, why not? The big issue I take with this is the government intervention. Getting "in trouble" for writing is one thing, getting prosecuted for it is something else entirely.
