Problem: My son rents a small house from a despicable, crotchety old man (not me- another one) The place has a lot of trees, and the roots invaded the underground pipes, causing the toilets to back up into the house.

The landlord said it wasn't his responsibility, and refused to pay the bill. My son is taking the old coot to court.

The question: what are the laws in states other than Colorado? How about in the rest of the world? Just curious.

In Washington State, this would be the landlords problem. It is his property and all maintenance, unless otherwise stated in the rental agreement, is the landlords responsibility. He should be the one to fix the pipes and to pay for repairs.

If it is presented properly, your son WILL win the case. This of course is assuming it can be proved that he knew about the problem beforehand, which may need to be drawn out of him through questioning in court.

*If so, and it can be proven, it's a clear case of negligence on the part of the property owner, and he can also be charged for the hotel bills for where your son stays.

*contrary state laws notwithstanding.

Or your son could just move elsewhere, and take him to small claims to recoup his deposit.

I work for a landlord and I have little to add beyond what everyone else has said. Up to the curtailage of the property it'd be the local authority's responsibility. After that, it's the owner of the property.


(Completely unrelated, but Broadmoor is a prison for nutters and mentalists around these parts)

(not that we lock them up just for being a nutter or a mentalist, they have to have done something naughty first)

(and not just the sort of naughty that involves shouting mean things to old people, more like pushing them under the wheels of a moving vehicle)

(which doesn't always stick in court. At least that's what my solicitor says)

Seriously, though, I think it depends on the state of the plumbing when he moved in. If there were problems from the outset, he shouldn't have signed the lease, or at least written a report on what sucked and had the landlord sign it and then have it notarized.

Actually, regardless of that, the landlord is required to provide means for suitable plumbing, gas, electric etc. Landlord just isn't necessarily obligated to pay for it.

I guess it comes down to the root cause (no pun intended) of the backed up plumbing. At a glance, I'd say it's the landlord's responsibility to make sure the trees don't interfere with plumbing, so it's his money. Additionally, we have stiff laws to protect tenants from retaliatory behavior from the landlord.

I live on the 2nd floor of a house, the landlord lives on the first floor. They yelled at me about bringing over my fiancee to sleep over, saying it violated my lease. I looked over my lease, concluded they were full of shit and have continued to do so. The sex is now louder just to spite them.

That's all I've got. I guess your son should just read every last word of the lease and check all state housing laws and tenants' rights. It sounds like he'll be alright ultimately.

I believe here in Missouri that unless otherwise specified, the landlord is resposible.

Sometimes not though but only in special renting situations.
For example, an aquaintance lives in a townhome community where she had to buy a membership. The inside of the townhome is considered hers and she is responsible for any and all repairs, remodeling, maintainance, but the outside is the responsibility of the management (damaged exterior, driveway damage, lawn care).

Here though, if it is a rental situation, the landlord is responsible.

I rent and I call the landlord unless it's something simple like replacing the toilet tank doo-dad. I had to do that earlier this year. Instead of waiting for the maintainance guy to get around to me, I just did it myself

People like you get us real estate people in the shit with landlords. The landlord will be nice over the phone to you, then 5 minutes later will be calling us complaining that the tenant called them. That's what generally happens hear anyway.

Mainly depends on the condition of the house when the tenancy agreement was signed by all parties. While it is the landlords legal obligation to keep houses in completely livable standards, I.E electricity and plumbing, etc in accordance with local laws/guidlines, if the lease WAS signed in full knowledge of the conditions you outlined, you'd still have a fight on your hands. In saying that, the old cunt should definitely fulfill his legal obligations and fix ALL the above problems.

Property management isn't my area of expertise, though obviously that shit all happens in the same office where I work.

The landlord is responsible for maintenance of the property. The sewer pipes are part of the property. The city/town/borough/whatever is only responsible for the sewer pipes up to the curbline.

In my state in Australia it would be subject to the terms of the lease agreement but the general rule is as follows:

Under s25 of the Residential Tenancies Act 1987, where the tenant holds under a "residential tenancy agreement", the landlord must maintain the premises in a reasonable state of repair (subject to a tenant's responsibility to ameliorate waste), having regard to their age, prospective life, and the rent payable. Once the lease has commenced, the landlord is not liable for later arising defects until the landlord receives notice of the disrepair, either from the tenant or from some other reliable source.

here in california, if you rent, you need renter's insurance to cover your own belongings, but problems that occur like this (roots clogging the septic system or sewer/water lines) are the responsibility of the OWNER, completely.

In fact, if the property becomes uninhabitable at any point due to threats to health, you are well within your rights to cease paying any rent until they resolve the problem. Also, they may be liable to repay YOU for hotel/motel expenses during the time the building is uninhabitable.

Fuck that old man. He probably knew the trees were causing a problem several years ago and did nothing.
