When I paid the rent this month, I included a short note telling my landlord that I'm in the process of searching for a new place, and I'd be out no later than March 1st. I also included a request that he allow me to live off my security deposit for the month of February, thereby allowing me to have the rent money I would have paid him available to secure a deposit on a new place (which I have not yet found). Follow that?
So the phone goes ringy-dingy yesterday, conveniently after I just polished off a half pint of vodka. (Which I drank mixed with Gatorade Lemonade, thereby proving beyond a shadow of a doubt that I have a drinking problem).
"Hello?" I say.
"Cough. Cough. (Grimm)?"
"Yes?"
"It's (Scumbag Landlord)."
"Hi there. I guess you got my note."
"Yeah, I wanted to talk to you about that."
Silence from me
"Right. Well, first I wanted to know why you're leaving - is there a problem?"
"No, no problem. Just time to move on, I think"
"Ok, well that's not a problem at all. But I can't really let you live off your security."
"Why not?"
"Um...(he seems shocked that I even asked)...well, you know, that's just not how we do things."
"We?"
"Um...you know, I just kind of need the money for February if you're gonna be living there."
"And that's why you just take the security. Seems kind of foolish for me to give you money, then you give it back to me a few weeks later. I'll just keep it."
"Well, I don't think you're getting the point here."
"That makes two of us."
"I'm sorry?"
"The note I sent you was pretty much a courtesy. Me living off the security for the last month isn't really a question I'm asking you - it's more of me telling you not to expect any more money from me."
"Well, that wasn't our agreement."
"We didn't have an agreement. I never signed a lease. I'm giving you way more than 30 days notice. And, without the money, I can't really secure a new place."
"Well, I don't see how that has to be my problem."
"Right then. Well - nice talking to you-"
"Don't you fucking hang up on me!" Scumbag Landlord says.
"Was there something else?"
"Well, for one thing the reason I insist on security is in case there is damage to the apartment."
"Oh, ok. Well, there isn't any. If anything, I improved this place. You're welcome to come see it at anytime, just let me know first."
"(Grimm), this is not going to work. I need that money."
"Listen, (Scumbag Landlord), you're not really in a position to argue here. It's not like you can evict me - I'm already leaving."
"I will take you to court!"
"I love it when landlords threaten me with court. I wish one of them would have the balls to follow through."
"Excuse me?"
"You sue me, and that means I'm going to stay in this dump, not paying you a dime, waiting for our eventual court date three months from now, and my appearance in front of a judge who will no doubt just give me another month or two to vacate the property. If it drags on for a while, I may be able to save up a down payment for a house with the money I'm not paying you."

By the by, eviction cases can be heard in less than 2 weeks and notice in less than a month, however, since you admittedly didn't sign a lease I would have you removed from the property, effective immediately. I wouldn't be the least bit surprised to hear how all of your belongings were outside by the time you got home.

We have a few investment properties and this is almost exactly what happened to one tenant when they pulled something similar to this (although a lease was signed etc). One day they lived there, next day everything they owned was in the carport and the entire house had new locks. Life's tough when you live on the street.
You are an arsehat of a tenant. If you pulled this shit on me, all your belongings would be in the gutter. Or in a skip I just happened to hire for the day and had collected at 5pm... before you made it home from work. Remember, your landlord has keys to your house.

What kind of idiot landlord doesn't require a written and notarized lease agreement? If you had a lease, you would have to pay him up front, but by allowing you to live there with no written contract, he's basically fucked himself. Good show.

That's how it works. You dont get your security deposit back until you move out. When you move in, you pay first month, last month, and security. Therefor you dont pay last months rent so that money you dont spend is to be put forth on a new apartment. Its a way to keep landlords from getting fucked over because there are a lot of assholes out there.
The way you told this story is makes it sound like he was trying to be a decent guy about it and you turned into a jackass. Well done. Go ahead and blame the alcohol, though. It's easier than admitting you acted like an immature dipshit.

I was going to launch into a rant about how you're acting a fool, considering you never signed a lease and apparently were not aware how things "are done" in this place, as the landlord put it, but Big Daddy Rhyme did most of the work for me. It really does just sound like you laid it down for the guy, he had a problem with it, and you turned around and told him to sit on it and swivel. This is a situation where the tenant doesn't get to make up rules, just because nothing legal was signed. This guy could have you thrown out much faster since you don't have an official lease, and from the sounds of things, you're kinda lucky it didn't go down that way.
You were a good guy by leaving a request with the last rent payment, but you really fell apart when the guy (basically) wanted to discuss it with you and you caught a case of the ass. Seems to me he was decent enough about it, not to mention not requiring that you sign a lease, which is essentially non-negotiable in most places. Just looks like you don't have the high ground here, is all.
You're still a good dude. Hope you don't wind up on your ass because of this.

Nope, in MSPaint #0000FF is just the standard dark blue. If you use custom colors in MSPaint, the correct color for the sky is #c4f0ff. That has been true ever since Windows evolved past 95!

Being a landlord, I will comment (with the other ones here)
State law (in my state) requires the security deposit to be held in an account in the tenant's name, and yearly reporting of interest accrued. At the termination of the rental period (whether a lease or not) the landlord is required to account for the $$$, interest and any charges to the account after a walk through with the tenant. Failure to do this can result in the landlord loosing 3X the security deposit in a court if the tenant decides to take him to court in contest of the deposit. I did allow this to be the last month's rent (once) and paid a dear price when the tenant decided to take me to small claims court.
Rightfully, you are a scumbag, trying to trap the landlord in a tricky situation.

I've tussled with three different landlords and never lost once. The simple fact of the matter is that most states tend to favor tenants; to do otherwise would be to create a power differential. If they didn't even make you sign a lease, they're pretty much relying on you to do to follow your end of whatever they interpreted the agreement as.

I did once have a landlord suggest that I couldn't possibly pay rent because I wasn't a good married Christian, and "[he] don't rent to no heathens!!!"
Then he evicted my Jewish friend...
I suppose it could've been a lawsuit, but it was a shitty Baltimore neighborhood in the first place and a good excuse to get the hell out while the getting was good.

By the way. In some states, mine included, landlords are not ALLOWED to use a security deposit as rent.

Not really knowing you yet thoroughly enjoying your dude series, I think you seem to be a decent guy and requested a "favor" from your landlord. Hell, just asked mine if I could split Jan's rent between first and last month's pays cause Christmas nailed me - but anyway - if he said no, you should pay him rent. It's a moral obligation and you seem to be a moral person.
My honest opinion tho is dude blew the deposit money on hookers and crack and losing your next rent payment means he has to blow business men in mall bathrooms to afford his next fix.

In Florida, you don't even have to worry about the lienholder. They're on their own. When you buy a house in Florida it's yours even if you owe the bank for it. The building(s) and the land it (they) sits on cannot be taken in bankruptcy or forclosure - State law. That's why people here buy such ginormous houses - it's a hedge against financial ruin.

As a scumbag myself, he is under no obligation to let you live off the deposit.
Its a security deposit - his security, not yours - what way of recompense has he got if you totally trashed the place in the last month?
Pay your rent, be good, don't smear shit on the walls, lie about the guy upstairs, and you should get your security deposit back at the end of the lease - standard procedure.

So, what I'm getting out of this exchange is that in the perfect landlord/tenant relationship, the tenant pays and pays and pays without complaint, and anything less than that and either the landlord or the tenant (or both) is a Scumbag. If I were the Scumbag Landlord, I'd consider having the Scumbag Cops come and arrest the Scumbag Tenant for trespass. No lease = no permission to be on the property. Simple as that. Scumbag Tenant would beat the case with his address on a utility bill, but not before he spent most of the night in Scumbag Jail while his Scumbag Stuff spent most of the night on the Scumbag Lawn.

Missed this little nugget. In Ohio, a landlord who does not return a security deposit within 30 days is subject to a $5000 fine, payable to the former tenant. Yeah, I think they would give it back.
Look up your state's tenants rights laws.

In NYC you have to be served by the Sh. Dept before you can be evicted, and to get an order of eviction and then get someone to serve the notice can take forever. If you don't have a lease its an implied month to month lease so you have 30 days before the landlord can file an order of eviction and then however long it takes to have the notice served and executed. He probably could be there until April without an issue as long as he is ok with taking the risk of coming home one day and all his shit is on the lawn.

You can't evict anyone during the winter months (in PA, at least). So, technically you're doing the guy a favor by living there for the winter, and keeping the place heated.

Whoa - such an outcry.
I hope it's clear that I'm not actually screwing the landlord out of anything, nor did I ever insist (as is my right) that the deposit was kept in a savings account and the interest earned given to me.
Nor did I trash the place at all. When i moved in I actually spent a whole day going around with paint and touching up spots where the previous tenant had hung pictures (because the landlord didn't even bother to freshly paint the joint).

That's a sad story creep. Really. But I've never lost a dime of a security deposit. I guess I just take better care of shit than you, right? Maybe I make sure damages ate move-in are reported in writing? Maybe I'm not a careless idiot who thinks that verbal agreements mean shit?
Here's the funny thing, you bleeding vag. I act, as you put it, "holier-than-thou" because I don't do stupid shit like think that not reporting damages in writing will mean it won't count as me having done it. I don't "trust" a landlord to not screw me, so I get things in writing. Simple things like the condition of the apartment or house.
Now, the other part is that I'm not so fucking cheap that I won't spend $50 to have a lawyer draft a nice letter pointing out that doing repairs is part of an obligation a landlord has to tenants. But that's a whole other comment.

Meh. I took a chance and trusted someone, Muddy. I signed a one year lease and didn't think she could really dodge the repairs for that long. Plus she had done some recent work like painting and new hardwood floors. I honestly didn't think it was a priority to take pictures of a wobbly ceiling fan. Chock it up to learning experience. However, you fucking douchebag, I didn't call anybody a dumbass. I called hads a "fuckwad" because he addresses everyone in a holier-than-thou, I'm-so-fucking-smart-and-you're-an-idiot manner. Get fucked HTBD. Landlords LIVE to screw tennants out of security deposits. You think a landlord that doesn't make a tennant sign a lease is going to give back a security deposit? My last landlord screwed me out of more than half my security deposit for damages I complained about when I moved in. I had nothing in writing and took no pictures so I couldn't prove anything. Besides, if I tried to fight it, I would've lost more than what the landlord owed me just taking the day off of work and court fees.

I think by paying rent even without a lease you are entitled to an eviction proceeding. It just won't take months when the landlord gets before the judge and says "he ain't on a lease and he ain't paying."

By the by, eviction cases can be heard in less than 2 weeks and notice in less than a month, however, since you admittedly didn't sign a lease I would have you removed from the property, effective immediately. I wouldn't be the least bit surprised to hear how all of your belongings were outside by the time you got home.

I have mixed emotions about this one. On the one hand my last landlord was a cunt. I wrote "final rent payment" on my last rent check and my roommate confirmed with him roughly 27 days before the end of the contract that we were leaving. Yet, a week before the end of the month landlord comes up with the "new" contract. Apparently he didn't think we were leaving. He also said we should have given him 60 days notice.
My deposit is nestled nicely in my bank account.
On the other hand you did mention that you didn't sign a contract, in which case all mothafuckin bets is off. He's lucky you were kind enough to leave him a note.
