and I feel like a horrible person because of it.

A couple months ago I bought a house in New York. It is a two unit upper/lower. I bought a 2 unit so that my mom could move up here soon even if she is not able to sell her home in FL right away. The house had tenants when I bought it. The woman downstairs is pregnant, and I still have my apartment, so I chose to let them stay until the downstairs people finished their lease (end of August) and just collect the rent (about $900/month for both places). The upstairs tenant is a nice old lady, her apartment is a small but comfortable 2 bedroom for which she pays $400/month. She does not have a lease and has been there for 6 years. There is some remodeling we plan on doing to the downstairs before we move into it and we thought we'd let the lady stay until we had finished it and my mom was ready to come up.

We told the real estate agent and the lawyers that we did intend to have the place vacant at some point but we were not planning to just rush everyone out, and to please make sure that the tenants knew that so there would not be any difficulties as far as collecting rent or them damaging the place in anger. We figured there would be a 4 to 5 month period before anyone had to worry about moving. Somehow this got confused between me saying it and the tenant hearing it, because when I collected her rent recently she seemed to be under the impression that we had no intention of ever asking her to leave and she would continue to rent the place indefinitely.

Now the downstairs tenants have called to ask me if they can break the lease and move in 30 days. I will still take 1 month to do the work I wanted to do but i can't really afford to keep my apartment til August after I lose the downstairs rent payment. And my mom can wait a little while as planned but the fact is that I bought this particular house for the sole purpose of having her here. So even if her circumstances or mine keep her in FL til this fall like we had previously talked about, I'm still going to need the upstairs apartment before the end of the year.

So I'm just at a loss. Contrary to popular belief, I am actually -not- a bitch. I am terrible at delivering bad news and I now have to tell this nice lady that she has to leave the home she's had for 6 years. I figured I would try and find another apartment for her that was comparable, which from my experience finding an apartment myself will be difficult but doable. Would that be weird? Is it going too far? I don't know how to go about this, I feel like it would have been easier to just make the previous owner kick everyone out before closing. Is there any way I can do this nicely? I feel like I should be wearing a goofy pencil moustache and an evil-looking black tophat :(

As for telling about my new house... Have faith, eh? As soon as I finish my remodel and move in there'll be a post chock full of pictures of my new dwelling, and possibly a "look how hot I am" shot thrown in for good measure! Oh maybe my car too? You guys wanna see my car? It's FUCKING SWEET!

Okay it's not that sweet. But I'm pretty sure it has superpowers.

I'd do some initial research, and print out some brochures of comparable places. Then just put the case forward politely but firmly. Don't make it seem like you're going to help her find a new place, or you'll be to blame in anything that follows. The mishearing may be intentional on her part.

I know it's hard to do, but it's much better coming from you than a lawyer. explain the situation you're in to her. If she is as nice as you say, she will understand about your mum. I think it's really decent of you to want to help her find a new place and it's not weird to offer to help her do this. She may very well need the help and will if nothing else appreciate the offer.

Be brave. There's no reason why you can't look out for her whilst looking after you and your mum. you know what you have to do and the more time you can give her the better.This isn't you being a bad person, this is unfortunately the downside of being a landlady.

Actually, buddy boy, I've moved on up... my boyfriend just got hired, then promoted (on his third day, *swoon*), at the best fine dining restaraunt in NY outside the city, making somewhere right around 72k a year (side trip to brag about my honey: he also will be published in the next issue of American Cuisine because his dishes are fucking amazing, also, I wish I could find a picture of the engagement ring we just picked out, it will make you cry), and most of the people I hang out with are also professionals, some of whom could buy and sell your ass twenty times over

Seems genuine. Not a good idea to kick an old lady out in the cold. Make an effort, talk to her, get her consent & help her find a new place. rents a re going down like crack whores on pay day, so it shouldn't be that difficult.

1. Check all local tenants' rights laws.
2. If you are an unincorporated landlord...that's just foolish. Have an attorney draw up papers outlining a timeline that complies with the laws you checked out in #1.
3. Don't rent out space to non-relatives unless the building is owned by a corporation because you are personally liable for ANYTHING that happens there in regards to injury.

Well, if you're intending on getting her out no matter what, don't wait to give her the news. The more time she has to search, make phone calls, and generally prepare, the better off she will be. Offering to help her find a place seems like a decent gesture, and I'm sure she will appreciate it even if she doesn't accept it.

I've always rented from big faceless companies, so I've never been asked to vacate. I have elected to, at times, when the rent went up or the quality of management went down.

Just be courteous and professional about the whole thing. Talk to her in person and explain the situation. Offer to help, but don't offer to help if you don't actually INTEND to; that's just giving the biddy false hopes and reliance on you.
