I believe Willie Nelson said it the best when he said "I think people need to be educated to the fact that marijuana is not a drug. Marijuana is an herb and a flower. God put it here. If He put it here and He wants it to grow, what gives the government the right to say that God is wrong?" (www.thinkexists.com) Out of all fifty states here in the Unites States, Florida has the harshest penalty for even simple possession. Few of our states find medicinal uses for marijuana legal, but under federal law it is still illegal and punishable. But Florida's laws are even more harsh then the federal government.
This issue is personally important to me because I suffer from terrible back pain and sleep apnea. For which marijuana has assisted in helping with both. After several car accidents and a compression fracture to my spine, back pain and I got very close. I already had trouble sleeping before the accidents, and tried several over the counter aids. None of them worked, and I have no insurance to go see a doctor, and a friend suggested marijuana. I tried it and did not feel as much pain in my back, and slept like a baby that night. My mother suffers from chronic migraines and prescription pill abuse. Her migraines are so intense that her blood pressure is so high it is about to cause a heart attack or stroke. For many years she was given prescription after prescription from so many different doctors, she found herself hooked on them and functioning in everyday life was becoming a difficult task. Marijuana does not take her headaches away but it does dull the pain slightly, but it relaxes her enough to get to sleep. Medicinal marijuana will also help the community because of how many people are incarcerated for only minor position charges. This is costing the everyday citizen tax dollars. Plus our local government still spends money to keep the laws progressing in a harsher fashion. If a father smokes a joint instead of opening a beer at home to relax after work, and gets busted for some reason only hurts him and the family. Our state pretty much says it's ok to get completely drunk at home no matter your responsibilities. But if you light up a joint to try to relax, you can get up to one year in jail and a fine.
Marijuana has a huge history in the United States and it all leads up to why things are they way they are today. Starting with 7000-8000 B. C. the first woven fabric was believed to be hemp, from a marijuana plant. In 1619 at the Jamestown Colony, Virginia, farmers had marijuana laws back then. But the law was a "must grow" law. You could actually be jailed for not growing marijuana. It is a good plant for the soil, and so many things can be made from it. You can make clothes and rope from hemp. Hemp at this time could actually be used as a currency. But I was not until the 1900s that marijuana was recognized as a recreational drug. In 1910 a group of Mormons traveled down to Mexico and when they returned they had some marijuana with them and were open about smoking it because it was not illegal. Needless to say the church was not too pleased with the drug. And in Utah church doctrine immediately became law, and the first state for marijuana prohibition was established in 1915. Many other states soon followed. By the 1930's there had been so many horrible stories about marijuana that linked it to racism and insanity. Dr. A.E. Fossier wrote in the 1931 New Orleans Medical and Surgical journal: "Under the influence of hashish those fanatics would madly rush at their enemies, and ruthlessly massacre everyone within their grasp." So marijuana's bad rap now linked it to violent behavior, when it could not be less true. Now from 1919-1933 the federal government was concentrating on the prohibition of alcohol. And there were no federal laws against marijuana at this time. Now since there were no laws and one could not easily be passed they just taxed it. But in 1930 a new division to the treasury department was established—The Federal Bureau of Narcotics, with Harry J. Anslinger as the director. In the history books, this is when the war on marijuana began. Anslinger was an ambitious man and dedicated his time to make marijuana illegal at the federal level. He has been quoted saying, "There are 100,000 total marijuana smokers in the US, and most are Negroes, Hispanics, Filipinos, and entertainers. Their Satanic music, jazz, and swing, result from marijuana use. This marijuana causes white women to seek sexual relations with Negroes, entertainers, and any others." Also, "marijuana is an addictive drug which produces in its user's insanity, criminality, and death." He then met William Randolph Hearst; he was an owner of a huge newspaper who benefitted from trashing marijuana. Marijuana was known to come from Mexico and Hearst hated Mexicans. He also invested heavily in the timber industry to support his newspaper chain and did not want the development of hemp to be in competition with paper. So this way he got to tell lies about Mexicans and how their devilish marijuana caused them to be violent, and it sold, so it made him rich. Here is something you could find in his paper. "By the tons it is coming into this country - the deadly, dreadful poison that racks and tears not only the body, but the very heart and soul of every human being who once becomes a slave to it in any of its cruel and devastating forms...Marihuana is a short cut to the insane asylum. Smoke marihuana cigarettes for a month and what was once your brain will be nothing but a storehouse of horrid specters. Hasheesh makes a murder who kills for the love of killing out of the mildest mannered man who ever laughed at the idea that any habit could ever get him..." So for two years Anslinger secretly put together a scrapbook, mainly of things from Hearst's news paper and brought making marijuana illegal at the federal level up to congress. Dr. Woodward opposed making marijuana illegal, and was just slammed by Anslinger and news papers, and after not too much argument on August 2, 1937 marijuana became illegal at the federal level. The bill was signed by President Roosevelt, which leaved a heavy tax on transaction of narcotics and marijuana. Now in Florida the law has recently changed. "Gov. Charlie Crist recently signed into law HB173/SB390, which carelessly lumps real drug dealers and small time offenders into the same category by creating the ridiculous judicial presumption that as few as 25 marijuana plants — one-fourth the amount the federal government considers a trafficking threshold — makes one a "drug trafficker." Florida already had the dubious honor of having the nation's harshest marijuana possession laws — less than 20 grams can land you in jail for a year and cost you $1,000. Even worse, possession of more than 20 grams is a felony. This new law puts Florida even further ahead of the draconian pack as the Sunshine State can now claim a trafficking standard 4 times as tough as the federal government's." (http://www.mpp.org/states/florida) The Federal Government is also harsh when it comes to a plant but not as harsh as Florida. "The federal government regulates drugs through the Controlled Substances Act, which does not recognize the difference between medical and recreational use of marijuana. These laws are generally applied only against persons who possess, cultivate, or distribute large quantities of marijuana.
Under federal law, marijuana is treated like every other controlled substance, such as cocaine and heroin. The federal government places every controlled substance in a schedule, in principle according to its relative potential for abuse and medicinal value. Under the CSA, marijuana is classified as a Schedule I drug, which means that the federal government views marijuana as highly addictive and having no medical value. Doctors may not "prescribe" marijuana for medical use under federal law, though they can "recommend" its use under the First Amendment. The Drug Enforcement Administration (DEA), charged with enforcing federal drug laws, has taken a substantial interest in medical marijuana patients and caregivers in general and large cultivation and distribution operations more specifically. Over the past few years, dozens of people have been targets of federal enforcement actions. Many of them have either been arrested or had property seized. More than a hundred are currently in prison or are facing charges or ongoing criminal or civil investigations for their cultivation or distribution of medical marijuana. The DEA, like local enforcement agencies, can choose how to make the best use of its time. Ideally, the DEA will leave medical marijuana patients and their caregivers alone. But federal law does not yet recognize medical marijuana, and the DEA is currently allowed to use the Controlled Substances Act to arrest people for its use. In many pending and past cases, the DEA and U.S. Attorney's office have used exaggerated plant numbers and inflammatory rhetoric, as well as informants who trade jail time for testimony, to justify enforcing federal laws against medical marijuana patients and caregivers in California and other states. Federal marijuana laws are very serious, and punishment for people found guilty is frequently very steep. Federal law still considers marijuana a dangerous illegal drug with no acceptable medicinal value. In several federal cases, judges have ruled that medical marijuana cannot be used as a defense, though defense attorneys should attempt to raise the issue whenever possible during trial. Federal law applies throughout California and the United States, not just on federal property. The key to federal property is that they are more likely than non-federal property to have federal officials monitoring it who will bust medical marijuana patients. Most likely, even if a patient is arrested and charged with a minor possession offense, he will be referred to the state authorities where he can assert a medical marijuana defense.
There are two types of federal sentencing laws: sentencing guidelines, enacted by the United States Sentencing Commission, and mandatory sentencing laws, enacted by Congress. The Sentencing Commission was created in 1987 to combat sentencing disparities across jurisdictions. The current mandatory minimum sentences were enacted in a 1986 drug bill.
Federal sentencing guidelines take into account not only the amount of marijuana but also past convictions. Not all marijuana convictions require jail time under federal sentencing guidelines, but all are eligible for imprisonment. If convicted and sentenced to jail, a minimum of 85% of that sentence must be served. The higher the marijuana amount, the more likely one is to be sentenced to jail time, as opposed to probation or alternative sentencing. Low-level offenses, even with multiple prior convictions, may end up with probation for the entire sentence of one to twelve months, and no jail time required. Possession of over 1 kg of marijuana with no prior convictions carries a sentence of six to twelve months with a possibility of probation and alternative sentencing. Over 2.5 kg with no criminal record carries a sentence of at least six months in jail; with multiple prior convictions, a sentence might be up to two years to three years in jail with no chance for probation. "Cannabis is said by most experts to be safer than Alcohol and many prescription drugs."With my youthful experiences with marijuana and consumption of alcohol, I know for a fact alcohol which is legal has more negative effects than state of mind of being high. But here in the US we are holding a medicine from people who could really use it. No persons under the age of 18 or 21 should be prescribes medicinal marijuana. Also "The question of permitting medical marijuana must be separated from the question of legalizing marijuana for recreation use." Now that we know the history, marijuana seems to have a bad rap, and not only are the people that could use medicinal marijuana affected but our economy is too. Science has shown a number of ailments that marijuana has been successful in treating. George McMahon and Christopher Largen wrote about a man whose medical history included nineteen major surgeries and many specialized doctors who treated this man including, urologists, neurologists, psychiatrists, osteopaths, orthopedic surgeons, general practitioners and chiropractors. He had been prescribed morphine, Demerol, Motrin, codeine, Valium, and a multitude of anti-spasmodic, anti-inflammatory, tranquilizing, sedating, and mood-altering medications. This man gave up on the lifestyle all of those medications put him through a later on said he just enjoyed pressing a joint between his lips, inhaling the sweet, fragrant smoke into his lungs. In a few minutes his pain had subsided." (p.23) Later on in the book the man describes marijuana simply as just making him feel better. He does not get giggly or intoxicated; it just eases his debilitating pain so he could move around. His legs would spasm at night, interfering with his sleep, but smoking a joint before bed allowed him to sleep. (p.48) This man actually used this plant for its intended purpose. "Cannabis as a medicine was common throughout most of the world in the 1800s. It was used as the primary pain reliever until the invention of aspirin." Now aspirin accounts for the deaths of 1,000 Americans a year and marijuana causes zero deaths a year.
Aside from one man's story of how marijuana helped him, science shows far more uses for medicinal marijuana.
•AIDS- Marijuana reduces nausea, vomiting, and loss of appetite caused by the ailment
itself and by the treatment with ATZ and other medicines
•Asthma- Several studies have shown that THC acts as a bronchodilator and reverses
bronchial restriction. Although conventional bronchodilators work faster, THC has been
shown to last longer and with considerably less risk.
•Arthritis and other Autoimmune Diseases. New evidence shows that marijuana is an
autoimmune modulator.
•Cancer- Marijuana stimulates the appetite and alleviates nausea and vomiting, common side
effects of chemotherapy treatment. People undergoing chemotherapy find that smoking
marijuana is an effective anti-nauseate- often more effective than mainstream medications.
•Chronic Pain- Marijuana alleviates the debilitating, chronic pain caused by myriad
disorders and injuries.
•Depression and other Mood Disorders- Marijuana has been shown to help- gently and
naturally. In contrast, conventional antidepressants drugs like lithium, tricyclics, and
MAO inhibitors have serious health risks and side effects.
•Epilepsy- Marijuana is used to prevent both grande mal and other epileptic seizures in
some patients. Other patients find that they can reduce dosage of other medications while
using cannabis.
•Glaucoma- Marijuana can reduce intraocular pressure, alleviating pain and slowing the
progress of the condition.
•Menstrual Cramps and Labor Pain- Many women use pot to ease the pain of menstrual cramps
and childbirth. Most do not tell their doctors in fear of losing their child, but their
children come out alert and studies show moderate smoker's children show superior psych-
motor skills.
•Multiple Sclerosis- Marijuana limits the muscle pain and spasticity caused by the disease,
and relieves tremor and unsteady gait.
•Migraine Headaches- marijuana not only relieves pain, but release of serotonin during
attacks.
•Paraplegia and Quadriplegia- Many have discovered that cannabis not only relieves their
pain but it's safer than opiates but also suppresses their muscle twitches and tremors.
•Pruitis- (Itching) Marijuana can be used orally and topically and may be more effective
than corticosteroids and antihistamines.
•Insomnia- Research shows pot can help people sleep. Without the side effects or tolerance
problems of other hypnotics. Cannabidiol is the active in pot which induces sleep. (Kubby,
Rosenthal, 1996)
So now we know that there are many uses for medicinal marijuana, but what about our economy. We are affected locally, state wide, and nationally. All of the incarceration done for marijuana just cost the taxpayers money. "Today, far more harm is caused by marijuana prohibition that marijuana itself. (Dudly, 1999) Rosenthal and Kubby I think broke it down the best. If marijuana was legalized the first thing we would see is a significant drop in price because of the availability and supply. So there would be increased usage. With the price drop and the amount of smokers the marijuana industry could gross $50-$53 billion a year off pot alone. The government spends that much fighting marijuana. Based on the experiences with vice taxes on cigarettes, liquor, and other substances, the federal excise and manufacturing taxes, licenses, and fees could generate $10-$15 billion a year. State licenses and taxes would generate another $7-$10 billion annually. (p.39) It also goes into detail about the jobs it creates, farmers stay in business and it stimulates our hurting economy. So the government is wasting time and money on enforcing the ridiculous laws instead of profiting and helping the economy.
We already know Florida has the harshest laws when it comes to marijuana and our current governor Charlie Crist signed off on these laws. But do we offer an alternate to smoking marijuana? We sure do and they account for the deaths of many individuals and the side effects are terrible. Here is a list of what is prescribed for most of the conditions marijuana helps with:
•Codeine
•Fentanyl (Duragesic, others)
•Hydrocodone (Vicodin, Lortab, others)
•Hydromorphone (Dilaudid, others)
•Meperidine (Demerol, others)
•Morphine (MS Contin, Kadian, others)
•Oxycodone (OxyContin, Percocet, others)
•Propoxyphene (Darvon, others)
Here are some of the side effects of some of these drugs. Codeine causes "Dizziness; drowsiness; excitability; headache; nausea; nervousness or anxiety; trouble sleeping; weakness. Severe allergic reactions (rash; hives; itching; difficulty breathing; tightness in the chest; swelling of the mouth, face, lips, or tongue); difficulty urinating; fast or irregular heartbeat; hallucinations; seizures; severe dizziness, lightheadedness, or headache; severe drowsiness; tremor." (http://www.drugs.com) And Hydrocodone, which these two are some of the most commonly prescribed drugs for pain. Get emergency medical help if you have any of these signs of an allergic reaction: hives; difficulty breathing; swelling of your face, lips, tongue, or throat. Call your doctor at once if you have any of these serious side effects: shallow breathing, slow heartbeat; feeling light-headed, fainting; confusion, fear, unusual thoughts or behavior; seizure (convulsions); problems with urination; or nausea, stomach pain, loss of appetite, itching, dark urine, clay-colored stools, jaundice (yellowing of the skin or eyes). Less serious hydrocodone and acetaminophen side effects may include: feeling anxious, dizzy, or drowsy; mild nausea, vomiting, upset stomach, constipation; headache, mood changes; blurred vision; ringing in your ears; or dry mouth. The side effects of these commonly prescribed drugs have more negative outcomes than smoking marijuana. How the FDA views these drugs as more appropriate than medicinal marijuana is beyond me. Our economy is in a terrible recession and we spend too much money throughout the economy on marijuana. Americans consume about 31 million pounds of marijuana every year at an estimated retail cost of $3,570 per pound. That adds up to an expenditure of $113 billion annually, all of it going into an illicit economy untaxed by the federal government. As explained by a new report in the Bulletin of Cannabis Reform the illegality of marijuana costs local, state, and the federal government billions in tax revenue. According to the federal Office of Management and Budget 28.7% of the gross domestic product - the total economic output of the country in a year - ends up in government's hands as tax revenue. So, the diversion of money into the marijuana market costs the government $31.1 billion annually. Marijuana arrests account for 5.54% of all arrests in the United States, which spends $193 billion annually on its criminal justice system. As such, marijuana arrests account for $10.7 billion annually in criminal justice expenses. Add it all up, and marijuana prohibition costs the US $42 billion every year. This is information that congressional representatives, presidential candidates, and policy makers need to know. I personally am completely for the legalization of medicinal uses for marijuana, at this point. Honestly recreationally to me is still better than alcohol. From my personal experiences with medicinal purposes marijuana serves, and with my mother having different ailments and marijuana also helped her symptoms, I feel our laws are just incorrect about the issue. I personally know people of all types of professions, successful people, good parents, and people struggling to make it, that prefer to smoke a joint than drink. All of these people have to live in fear from our government for inhaling a bud from a naturally growing plant. The original leaders of our country grew and most likely smoked cannabis, and because of Anslinger and his yellow journalism marijuana became illegal on false pretenses. It is very difficult to get a law overturned, and many have tried. I feel one day our government will wise up and see marijuana as America's cash crop. Our hurting economy spends billions on this issue that to me is not an issue at all. Zero people a year die from marijuana usage. How many other "drugs" have that reputation? Families are hurt by incarceration of individuals for only minor possession charges and this reflects our government not looking out for the everyday man. Put all that money saved on fighting marijuana and put it towards task forces to fight cocaine, meth, or ecstasy. Also, out of all my research into this issue, the only logical rebuttal for the prohibition of marijuana was that it contains more tar than a cigarette. I feel with all the proven positive things marijuana has medicinal purposes for, and the lack of legitimate argument otherwise; marijuana should become federally legal or decimalized.

It's hard to imagine people are still getting hassled for weed. Just the other day, we were walking along the sidewalk above McCovey Cove after watching the Angels beat the Giants for the third time, in a big crowd of people, smoking a bowl. No one looked twice or even asked for a hit. My mother, who is about a hundred, told me some guys were selling KGB on the bus the other day, just walking up and down the aisle offering it for sale like it was T-shirts or stolen mobile phones. And that's the shit we were smoking after the game.

I actually agree that any natural plants like opium, grass etc are natural are TOTALLY acceptable.
My problem is with the chemical drugs that you don't know whats been put in it. When I was 18 (20 years ago..aggh) all my friends were on acid and ecstacy. I was never ever interested even though they laughed at me.
I'd eat mushrooms like a shot though.

You've all completly missed the point. This is not at all about being a stoner, it's not even about smoking weed or being a "burnout" which seems to be everyone's scapegoat when it comes to this situation. Not only that it can save our evonomy right now. Some countries have oil, diamonds, gold, and such. We have the worlds best cash crop and have the place to grow. It's great from the air, a beautiful plant with healing abilities. It's completly natrual and unprossed by the FDA, please tell me you people who argued against this drink or take perscrition pills. Those are so much worse for your body with tertible side effects. While not only being able to produce billions for government spending it could assist in rebuilding out children's education system.

Smoking while pregnant can kill your baby. A friend of mine had her baby come out stillborn because smoking marijuana everyday caused her placenta to break down, depriving the baby of oxygen and it died. We all warned her that what she was doing was wrong and that she should tell her doctor. When her baby came out dead none of us knew what to say because when we said what she was doing was dangerous we didn't know it would kill her baby and she couldn't face us because we had warned her. Needless to say we arn't really friends anymore.
Marijuana use also causes pre-existing mental disorders to come out in certain vulnerable members of the population. It exascerbates medical conditions such as emphysema, it irritates the throat and mouth and can cause cancer. Driving while smoking also reduces your response times and can lead to road fatalities. This is all fact not government propaganda.
Yes I admit I enjoy a smoke, but it is illegal for a reason.

Smoking while pregnant can kill your baby. A friend of mine had her baby come out stillborn because smoking marijuana everyday caused her placenta to break down, depriving the baby of oxygen and it died. We all warned her that what she was doing was wrong and that she should tell her doctor. When her baby came out dead none of us knew what to say because when we said what she was doing was dangerous we didn't know it would kill her baby and she couldn't face us because we had warned her. Needless to say we arn't really friends anymore.
Marijuana use also causes pre-existing mental disorders to come out in certain vulnerable members of the population. It exascerbates medical conditions such as emphysema, it irritates the throat and mouth and can cause cancer. Driving while smoking also reduces your response times and can lead to road fatalities. This is all fact not government propaganda.
Yes I admit I enjoy a smoke, but it is illegal for a reason.
Anyway why don't you just become an oxycontin addict like the rest of the hillbillies?

I just read one of your responses in the reviews below, and I feel I should correct something you said in error. As a beginning, fresh-out-of-law-school-and-haven't-passed-the-Bar-exam-yet JD, you don't MAKE $175/hr, you BILL $175/hr for the firm. You'll see maybe 15% of that (assuming you meet the 50-60 billable hours a week goal you'll be required to achieve) until you pass the Bar, and then you'll see about 20% of it (same number of hours/week, though), because without the Bar, most of the firm's clients won't even let you help on their cases. Just thought I'd clear that up for you.
Don't feel bad: (0.15)(175)(50)(50) is still better than 65$K/yr. Not bad for a starting salary. Of course, it's less per hour than the county pays the guy who picks up my garbage, but he's been at it for like five years.
And lastly, that stuff with the parenthses in the previous paragraph; that's math. Google it if you're confused.

This is about as serious an effort at reformatting a shitty post as I'd expect from someone who apparently thinks smoking weed improves the ability to concentrate. It's still poor, it still fails to make any point (presumably including the one you were going for), and it still portrays you, the "author", as a stupid, whining little teenager who'd rather get stoned and sit around the house than take responsibility for his situation.
