Jeff had just graduated from the University of Michigan, received a well paying job out in Colorado, and, with Mary, his girlfriend of two years, was envisioning what life would be like when she graduated and could move in with him. But when he moved away for his job he was dumped. He told himself that it was just a distance issue, and since he hated his job he would just quit and move back and everything would be fine.
He just finished some on the job training and found himself having 9 days off while they relocated him to a new city. Since he had the time off he drove the 15 hours back to Ann Arbor to visit Mary. He showed up at her apartment at 9 am, greeted by a warm smile and a hug. He spent the day hanging out with Mary and her best friend Lauren, just like it used to be before he graduated. He soon found out that as much as Mary still liked Jeff, she did not want to be in a relationship with him. But Mary valued his friendship and told him she still wanted him in her life. Friends with certain benefits it seemed since their first night together Mary was all over Jeff.
The next day Mary told him they couldn't do that anymore. That night instead of having sex they just slept in the same bed together making out.
The last day he spent with her she told him she didn't remained steadfast in her no sex policy. Two weeks later Jeff's cell phone rang
"Hey Jeff, it's me Lauren."
"Hey Lauren, what's up?"
"Not much. Listen, I have something important to tell you. Mary has been saying that you raped her when you were visiting. I want you to tell me what happened. Jeff? Jeff? Are you there?"
The phone had already hit the floor by then.

My favorite variation on this theme is the "she was too drunk to consent so it was rape because she couldn't make an informed decision" side. That is true. I read the sentence as her protesting what he was doing WHILE he was doing, but I can see how it could be read as she was enjoying what he was doing, but still saying no to sex. If the former is the case, than I stand by what I said. If the latter is the case, I still stand by the second part of my reply which was:

If i wanted to have people come to the conclusion that she is a lying bitch, I wouldn't have said she said no repeatedly. But what I posted here is almost exactly what happened. He told me himself that he had to "persuade her" to have sex with him, and that oral sex was included in this. I also made the case on how she felt pinned down by him, because with him having 60 pounds on her that is logical to see how that could take place. As to who i believe in this scenario, I'm not 100% sure.

Now, here you saw it's a no -sex- policy. Sex would be considered any sexual act (bj, whatever), and not necessarily 'penis-in-vagina' (to be technical), but I think that's what you meant, since the making out and what not.
Number one: You said it was your friend, and to just jump to the conclusion that he is telling the truth and the girl is a lying bitch just because you heard his side of the story first is wrong (something it looks like some of the previous reviewers did, and you shouldn't necessarily jump on his side just because the guy is your friend).

I think this is an example of one of the worst crimes that happens in relationships. Everybody has confused feelings, does things that are in the 'grey area', feel guilty about not sticking with their principles, so therefore decide the all of the blame should be laid on the other person.
From a person very familiar with date rape, I have to say that if this was the true version of the story, mary needs to grow up and accept responsibility for her actions.

Also with the obvious weight differentials, during sex she very well could have felt pinned down. It is a sticky situation to say the least.

Eh. Some day all sex between a man and a woman could be classified as rape. Men will pay millions in insurance premiums similar to the malpractice insurance doctors pay to practice so they can settle out of court with thier partners for a few 100K instead of going to jail. Ok, I am going to give you my honest opinion, because you asked for it. I am apoligizing in advance if this causes your post to get on most heated, or if what I say in general gets people angry.

While what is described here is not rape, it is most certainly sexual assault of some kind (and according to NYS law at least, illegal and prosecutable *that may not be a real word*). Uninvited touching, kissing, clothing removal is a crime. Doing those things amidst protest is even worse. It is illegal to force yourself on someone else in any sexual way.
Hear me again, what is decribed there is NOT rape. But it is at the very LEAST sexual misconduct (also a crime) and ALMOST definately sexual assault (which (again, I only know the NYS laws) carries the same penalty as rape in the third degree, I believe).
In any case, it is wrong, and he (you? not sure.) should have stopped when she said no. There is a VERY clear line between seduction and force. Nibbling a girl's ear is seduction. Nibbling a girl's ear when she tells you to stop is force.

Many people consider this to be the sure sign that it is consensual. This is a problem because of basic anatomy. A woman's clitoris reacts to stimuli whether is it invited or not. She cannot do anything about it. She cannot make herself stay dry and not FEEL. I hope you understand what I mean by that. There have been clear-cut rape cases (I'm talking stranger in a back alley grabs a girl and beats her up and rapes her) in which evidence of vaginal excretion has been found. Because the body reacts completely separately from the mind. It is an uncontrollable reflex.
I know that you are perhaps looking for some kind of answer here. A clear cut, "it was rape" or "it was not rape".
I cannot give you that.

I don't know the details of the case you are reffering to, but I think the circumstances would really determine what a jury thought of this situation. The fact that they have been dating and sexually active for years would probably make a difference.
I am by no means stating that date rape doesn't happen or that someone in a long term relationship can't be raped by his or her partner. I just feel like this situation sounded like regret on her part, not rape on his. Of course, there are two sides to every story so we will never really know.

Sorry to hear this happened. There is one thing that keeps sticking out in my mind though, and that is "Date Rape". It is still considered rape because she continually said 'NO'. During my "dating" days, I used to ask them several times "are you sure you want have sex". The reason I did this was because I once saw a TV show or movie, where there was something very similiar to what you've explained here and the woman had said no and the man was persistant and got her "hot and bothered". She had sex with him, voluntarily in the end, but she did intend to. The case went to court and he was found guilty of rape.
Always keep one thing in mind, No means No.
I know I'll catch alot of shit for this, but unfortunately it does happen.

At the very most, this was bad judgement on her part. And that is only if she really didn't want to continue a physical relationship with this person. I cannot see where allowing yourself to be seduced can be called rape.
While I don't believe all rape survivors kick, fight, scream, and scratch during the attack. I would lay some serious odds against someone who has been raped, cuddling during the afterglow. Pure bullshit.

Ok, here's a female perspective.
For the person who asked, my definition of "rape" is non-consensual sex. Inappropriate touching and whatnot is sexual assualt in my head. If anyone wnats to draw the line somewhere else, I'd be interested to hear it.
I was raped. In fact, I was beaten about and raped, before being thrown through a glass door. I didn't tell anyone for a long time afterwards, and sat down very recently for the first time to write about it. You can find it in my post history, I'm not linking it. I was in a house I knew, with a person I thought I knew very well. But I said no. Not once, not twice, but repeatedly.
Why do girls do this? I don't know. It makes it very, very difficult for those of us with genuine cases to get justice. There are few things more damaging to a man than false allegations, because no matter how many times he protests his innocence, and even if he is cleared, his reputation has often been damaged to the point where his only option is to pack up and start again somewhere else.
I'm sorry if this is slightly incoherant rambling. I guess what I'm trying to say is that girls who do that deserve to be lynched, but please don't tar us all with that brush. Some who call it are not lying, and some who should call it never do.
