So folks, it has been a long time since I've posted here, but I need your help. Here is my story:

So exams are coming up and I decided that I needed some Adderall. Having a lapse in judgment, I decided to buy some from someone that I didn't know. I met up with the guy on campus at my university which will remain unnnamed. I bought it and then asked if he was going to arrest me, jokingly. He said, "no I'm not even a cop." So I walk back to my car and sure enough two other men follow me back and flash their badges at me. The next thing I know I am in the university police station being questioned by detectives. They tell me that I am facing felony possesion of a schedule 2 substance. We all know what it means when you get convicted of a felony. It means the government gets to fuck you up the ass until you die.

Here is the thing. I am on a full-ride scholarship and since this happened on campus I will definitely have to go up against the judicial court at my school. I will probably lose my scholarship, I will probably be suspended for a semester, and I could very easily be expelled (they don't receive any money from me anyway, so why should they keep me around?). I am fairly positive that I am going to be fucked when it comes to school, so anyone who has been expelled from college please give me some advice on what to do.

Here is another thing. The cops spent about 2 to 2.5 hours questioning me (I just wanted some Adderall, what the fuck is the big deal?!). I was first interviewed by a nice, patient guy and I gave him as little information as I could possibly give and he seemed satisfied. He seemed like he wanted to help me out in judicial court and he told me that I was probably only going to face probation at the most in a criminal trial. Then some other detectives (the same ones that busted me originally) came by and really started grilling me. They were telling me that I was lying and that I could face perjury charges and all this shit. The whole time they were telling me that "I could help myself by helping them" (ie ratting out anyone and everyone that I had even heard mention something about drugs). I didn't name any names or give any phone numbers, so they started getting more upset with me.

Finally they took me into the interrogation room (the one with nothing but a few chairs and a small table with a tape recorder on it). They continued to tell me that they knew I was lying and that they knew that I smoked pot and that they knew that I could get drugs from a number of different sources. I continued to deny everything and told them that I knew nothing. One of the guys had a form in his hand that was filled out and he kept telling me that, all he "had to do was X the box and I would be taken to prison." Of course I believed him, but that wasn't going to get me to talk. So I kept my mouth shut and told them that I would try to help them out in the future (!!!) but that I dont know any names at the moment. Finally they decided to give me "one more chance." So the guy says that I have to call him by tomorrow and help him out (basically they want me to rat) or else he will have a warrant out for my arrest. Then of course they asked to search my car and since I didnt have anything in there I let them (even though I didnt have to, I just wanted to waste more of their time).

So I think I will call the guy and tell him that it is against my conscience to put anyone else in the position that I am in and that if he wants to make an example of me, then so be it. Then I will tell him that if he wants to crush a students hopes and dreams just because he wants to get help studying then fine, but I hope he can sleep well at night knowing that he just fucked over a good person, a person that has never harmed anyone but himself.

Anyway, I've been drinking since I got out of questioning so I'm sorry if I ramble. I just want to know if anyone here has been in this position, can sympathize, has advice for me, etc. I also think this cop could very well be bluffing. I am sure that I will at least be put in front of the university judicial court, but is this guy honestly going to put out a warrant for my arrest after giving me a full day to think about things? I think that this is the guys final trick to get me to rat on people. If I don't rat someone out by tomorrow I still don't think the guys going to do a damn thing. But I could be wrong, and that is why I desperately need the advice of the bright people of ubersite.

I contacted a lawyer already and got a lot of help. I was given the name of a bail bondsman in case I end up in jail. I was told to plead not guilty and ask for a PTI (Pretrial Intervention). Unfortunately I will have to use a public defender unless I can get 3500 dollars for the lawyer to represent me.

I will say this one more time.
Do as I said below.
Do Not listen to anyone here.
Hire an attorney NOW(Pref. a retired judge in the area, or one of his old associates)
Listen only to him.
HE CAN STOP THE PAPERWORK before it gets into the system.
If you are too stupid, to not become the "oil", that keeps the machinery running, then
maybe you should't be on the street anyway.

Well I just called the cops back like they asked me to. I told them that I had no further information and that I was sorry and I hoped they could accept that. Then I asked where we go from here. All he said was that they will file charges and that I will go to judicial affairs. He was very nonchalant about the whole thing, unlike yesterday.

This is basically what I expected to happen. So it seems like no cops are going to bust my door down and arrest me but I guess I will have to face a judge. I'm not sure how long these things should take, but I imagine I will have enough time to finish my exams and get a lawyer. Does anyone know how long this should take?

Some of these folks have it right, the district attorney is the only one that can make a deal with you...I used to be a cop, trust me, cops will tell you ANYTHING to get you to give up info. The arresting officers have little to no power after an arrest. The cops can't really "HELP" you anyway, all they can do is make a recommendation to the DA, if they say they can get you off, they are liars.

Call thier bluff.

Tell them you know no one else and you hope they can accept that.

If they have enough on you then it's their discretion on when and where to fuck with you. This is a bad place to be in.

Ride it out, admit to nothing and speak with your parents man better to hear it from you than someone else. I know that is a tough concept to grasp but believe me you need someone on your side and your parents certainly will be.

What's better to confess now (to parents), accept their disappointment but they get a lawyer and help you out possibly save you college career there.

Or

Wait till they call you parents or you are already standing infront of the judiciary board.

First things first call the cops back tell them you have nothing and see where they go from there. At this point it's poker and you need to throw down a strong bet to see what they have in their hands but don't be cocky.

What, EXACTLY have they told you that you are going to be charged with (it may be in the post, but I only skimmed).

You don't need a lawyer. They're not gonna get a warrant for you. They can't even
arrest you at this point, because of the time elapsed since the crime was committed.
If they summons you for possession, go to court and plea it down to something minor.
Don't rat anyone out.

At worst, you will be issued a summons to appear in court. At your arraignment, you can plead not guilty and maybe get a public defender lawyer if you met the income requirements, etc. However, to keep stupid shit from bunging up the courts, you might have an opportunity to plea the case down to a lesser charge (if you will plead guilty)during a meeting with the DA or someone from that office.

You cannot be arrested since the crime is no longer "fresh" - to much time has elapsed. The only way to be arrested is with a warrant, and I doubt anyone will bother, because those cops should have arrested you when the crime was committed, and a good judge would ask them why the hell they didn't do that in the first place before he/she issues a warrant.

Cops want to catch "bigger fish" and you are their route to doing so. You don't have to tell them squat, and that's that. You don't have to be an asshole about it (that will only piss them off) - just tell them you're not gonna talk to them. They can summons you to court.

I do not believe that I was denied legal council. As for the guy that said something about me being in the interrogation room without a lawyer, I basically just sat there and said nothing, while they chewed my ass out about how much trouble I could be in.

Thanks. I am not lying. I want to get a lawyer but I have little money and I want to try to take care of this without involving my parents at all. I think they would be crushed if they found out that I fucked up.

Have you ever heard of a police officer turning someone loose and giving them a day to call in with information or else putting out a warrant for their arrest? Because that is what happened and I have never heard of that before.

Someone made a comment about them reading you your rights.

Technically they can detain you for a period of time (varies from state to state), and they don't have to read you your rights until you are CHARGED with something, this usually happens when you visit the magistrate.

Do yourself a favor. Get a lawyer now. Enroll yourself in a voluntary rehab program. You might be saying what the fuck? but when you go infront of the judge and show him that you voluntarily got help for youy "problem" there is a good chance you'll get a "stet doc", or the case will be dismissed. BTW a stet doc (SP?) is just when they decide not to prosecute at the current time, but keep it on the books so if you ever become a repeat offender they can hit you with multiple charges, but after 3 years you can have it expunged.

I've been there and done that, bite the bullet and act REALLY sorry

I knew that and i'm only 17 without any experience with lawschool.

The man wont do shit on a first offense. They know nothing more than the fact that you purchased someone else's perscription. If they released you, they don't have enough on you to KEEP you in jail. Therefore, its no big deal.

I'm currently in a bit of trouble with the law myself and its pretty gay, but if you keep your shit together and dont frreak out you'll be fine

I don't know your situation, but if you get suspended a semester and have to live at home your parents are better off knowing now then later, and at least you can ask them for help with a lawyer.

I have read comments about how it is just possesion and a first time offense so you will just get a slap on the wrist. This is true if you are in a big city with worse crimes, or if you have a good lawyer. However if you are in a college town, I am sure there a lot of judges/lawyers/cops who would like to get one of you punk college kids. Do not mess around with this, you have a lot to lose.

Get a lawyer.

Again listen to what is said below don't say anything about yourself (no admissions) or anyone else.

Don't get into conversations with them meaning if they exchange with you keep your mouth shut. This because over time it will get difficult to remember everything you had said.

If they question you further, request a lawyer immedialty and if they haven't read you your Miranda Rights yet nothing you have said is admissable anyway. (I believe, I am no lawyer but have been in plenty of trouble)

Lastly, watch out for the guy you seem to think wants to help you out, he is the one you have to fear the most.

Just to repeat what's been said below. Say nothing. Maybe in the emotion of your situation you have forgotten how incredibly minor your offense is. They're trying to use you as a "Key" into bigger criminals. If you kill their enquiries by not giving anything away, then you stop the potential snowball effect that could end up with someone higher up getting a huge sentence. Take the punishment, it will be the most painless for everyone, and will probably only end up as a warning.

The advice I can say is this. Don't say shit. Don't even say sorry. I have met people who have been caught buying crack from a cop and the most they got was 2 weeks.

It's your first offense so they won't do shit to you. If you get a good lawyer the most you will get is community service and some drug rehab bullshit. I stress don't say shit. The cops have a case because you did buy drugs. But They have no reason to know that you know anyone who would sell some. Deny everything they say and don't say shit.

The worst you will get is community service that is if this is your first offense. When you do go infront of a judge( you probably will if the guy is a dick) stress the fact that you have been having hard times, and you have never done anything like this before. If it is your first offense you can get a defferal.

Plus if it was serious enough you would be in jail right now. They can't get shit from you so they're trying to make you rat. I say don't rat. Say you don't know shit. Be strong and calm. Never admit to anything besides what they got on you. Keep your mouth shut. Get a lawyer ( public pretender) and stress a defferal. Judges usually give them to college students.

Now this is something that I need. So far I havent ratted anyone and I dont plan to. Please clarify the whole thing about time-elapsed since the crime was committed. This could be just the information that could save my butt.

Being a certified counselor and having worked w/ juveniles in rehab, all I have to say is:

YOU'RE FUCKED.

Never ever buy ANY non-OTC drugs from anyone that's not a pharmacist and/or w/o a prescrip. It's just really dumb.

No, they haven't technically arrested me yet. If they arrest me then they are going to throw me in prison until I go to trial or post bail, this is not a "jail sentence." This is when I will get a lawyer. If they mention the words "you're under arrest," then the next words out of my mouth will be "I want to talk to a lawyer." That's what I mean. I realize it came out a little wierd earlier, but again I have been drinking since I got out of questioning.

I should clarify. When I say that this guy probably won't arrest me after a day, I don't mean that he is going to leave me alone. I just think that he has no intention of arresting me and that when I call him back tomorrow and tell him that I still know nothing he will tell me something along the lines of, "well I'm done with you, and the judicial court will punish you enough when you get expelled from school." Uhhhhhhh... do you realize you just said you would get a lawyer AFTER you got a jail sentence... perhaps some time in the clinker wouldn't be a bad thing.

I would love to get a lawyer, but I am a college student on a limited budget. The only way to get a lawyer is to tell my parents what happened and I don't want them upset about the whole situation. I want to try to take care of this myself. I will only tell my parents if I end up with a jail sentence (unlikely) and then I will tell them to bust me out with the best lawyers they can get.
