Now let me get this straight. The fifth ammendment allows governments to take private property through eminent domain if the land is for "public use." Okay fine. If the town is going under and officals decide it is vital to bost economic growth then fine. However, it is now ruled that
local governments, which would naturally extend to include wealthy developers, corporations and businesses, can may seize people's properties for PRIVATE economic use.
That's how I am reading this. Am I understanding this wrong?

WASHINGTON (AP) -- -- The Supreme Court on Thursday ruled that local governments may seize people's homes and businesses -- even against their will -- for private economic development.
It was a decision fraught with huge implications for a country with many areas, particularly the rapidly growing urban and suburban areas, facing countervailing pressures of development and property ownership rights.
The 5-4 ruling represented a defeat for some Connecticut residents whose homes are slated for destruction to make room for an office complex. They argued that cities have no right to take their land except for projects with a clear public use, such as roads or schools, or to revitalize blighted areas.
As a result, cities have wide power to bulldoze residences for projects such as shopping malls and hotel complexes to generate tax revenue.
Local officials, not federal judges, know best in deciding whether a development project will benefit the community, justices said.
"The city has carefully formulated an economic development that it believes will provide appreciable benefits to the community, including -- but by no means limited to -- new jobs and increased tax revenue," Justice John Paul Stevens wrote for the majority.
He was joined by Justice Anthony Kennedy, David H. Souter, Ruth Bader Ginsburg and Stephen G. Breyer.
At issue was the scope of the Fifth Amendment, which allows governments to take private property through eminent domain if the land is for "public use."
Susette Kelo and several other homeowners in a working-class neighborhood in New London, Connecticut, filed suit after city officials announced plans to raze their homes for a riverfront hotel, health club and offices.
***New London officials countered that the private development plans served a public purpose of boosting economic growth that outweighed the homeowners' property rights, even if the area wasn't blighted. ***
Justice Sandra Day O'Connor, who has been a key swing vote on many cases before the court, issued a stinging dissent. She argued that cities should not have unlimited authority to uproot families, even if they are provided compensation, simply to accommodate wealthy developers.
The lower courts had been divided on the issue, with many allowing a taking only if it eliminates blight.
"Any property may now be taken for the benefit of another private party, but the fallout from this decision will not be random," O'Connor wrote. "The beneficiaries are likely to be those citizens with disproportionate influence and power in the political process, including large corporations and development firms."
She was joined in her opinion by Chief Justice William H. Rehnquist, as well as Justices Antonin Scalia and Clarence Thomas.

This is older...but I had to answer. Think to yourself, "If this was a conservative Supreme Court, would abortion be legal?"
Sure, 7/9 of the court was appointed by republicans, but it doesn't mean the judges are conservative republicans. Actually, nearly always the choice has backfired for republicans.
The worst is Reagan's last appointee in 88. He's a flat out dud.
Also, the 3 that voted against this decision are the only 3 that think Roe V. Wade should be overturned... THE MOST convervative judges on the bench. And here you go, "It is a conservative court", or anyone else who blames conservatives.
Property rights are VERY, VERY, VERY important and most conservatives are die-hard believers in Adam Smith's economic theories. (Think about it...communism, or in some socialist societies, LAND OWNERSHIP is AKIN TO EVIL. This decision strips all property owners of their rights. It directly goes against the constitution which says "PUBLIC USE".
Bush's nominee is a definate believer in the constitution from what I've seen about him. That's good stuff right there.

Communism works well on a centralised community with socialised industry. The bigger and less centralised/industrialised your nation is, the more capitalist you need to become. National socialism is probably the right balance for most western, idustrialised nations today.

This is not thw situation.
Not at all.
This is a basic Constitutional right that hase been misused by idiots.
The people they are EVICTING are fairly prosperous, the town is doing good. Maybe the "town" could do better if they are kicked out. But I think not, i think friends of friends have a buddy who is a judge and made people sell. It is a perversion of the constitution!!
This opens the door for any local law maker to order people out of their homes because his cousin has stake in a strip mall that might be built there.

Somebody mentioned this as a States right Issue, I don't see it that way at all.
If a case came before the supreme court where New Hampshire outlawed guns, or Alabama adopted Baptism as the official religion, and the Supreme court said it was okay would you see that as a States right issue? Those are much clearer cases of what is and isn't allowed under the constitution. Emminent domain requires a little more clarification, and the supreme court decided to take more rights from people and give them to the Govt by allowing them to decide that a good taxpaying successful community wasn't successful enough. It is clearly a party line case, and represents the worst of Democratic ideology, I am not saying republicans are perfect, but this decision toes the party lines. It has nothing to do with states rights.

This is not about Conservatives vs. Liberals or Democrats vs. Republicans. People, wipe the affiliations from your narrow minds for 2 seconds and you'll see that this is about ALL OF US! This is a ruling against the common citizen no matter what their political affiliation.
This is about those with lots of money now having the ability to legally push around those without it. THAT'S what this is about! It's about, plain and simply, the death of one of the founding principles of this country, and it sickens me because I just watched CNN coverage of it,and they are treating it with far less focus on the obvious implications than you would expect from a respectable news organization.
This is not something that will simply pass, people. If we don't do something now...if we don't write our Congressmen about this, then we have failed future generations in this country the BASIC RIGHT to own a piece of property without fear that the local government, along with some faceless corporate entity, can just come in and take it from you anytime they see fit.
Seriously, like I said before, what has happened today - this little news story that will surely pass under most people's radar - will have more negative impact on the freedoms that we profess to love so dearly than all the terrorist attacks we've ever been the victim of.
The question is: will we just lay down and take it?
Will we just let our government, regardless of whether it's a Republican or a Democratic majority, continue to divert our eyes while they stick their greedy, oil-drenched, kickback-taking hands in our private lives, our piggy banks, and now our personal property?
For me, at least, the answer is a big HELL FUCKING NO!
As far as I'm concerned, those justices can take their unconstitutional. abuse-of-judicial-power ruling and shove it up their white, wrinkled, corporate cum-soaked asses!

In other horrible news, I heard on the radio today that the Canadian government is expecting a flu pandemic within the next few years. Yes, PANDEMIC (but with less zombies). They expect that thousands upon thousands will die and 5 million will be hospitalized by flu strains that have become resistant to anti-biotics.

stop fighting about that. us as citizens are in the same boat no matter what our leanings.

This happened in Ohio not too long ago - they had a story on 60 Minutes about this.
The mayour of a small Onio town decided to tear down some people's houses to build a golf course and shit like that.
Eventually, they voted the mayor out - which is what they need to do in New London.
It's very simple folks, this is communism in action, plain and simple.

homes are not in a community that's hurting for funds.
Kinda reminds me of that country over there <umm...name please> where they are razing
the demolished homes from the tsunami in december to make way for a resort.
The people standing by what's left of their homes, people lived there for generations,
were kicked off the land. By their law if you have been settled
some where for many years the land is yours. These people had nothing and lived in
unconventional housing. Greedy developers decided it was the perfect time to start
razing the demolished homes. Those poeple just lost everything including family members.
I read about this back in january or february. At the time is was being battled in courts and I never saw the outcome. Thailand??? indonesia??

Local government has always been able to use immenent domain proceedings to obtain land for public improvements like highways, water towers, parks, etc. What grabs my attention is that the improvements proposed in Connecticut are PRIVATE improvements. How can a municipality act as a governing agency in the interest of their constituents, AND as a real estate developer without having conflicting interests? This makes no sense!
One thing with immenent domin is that the parties that own the land being condemned are compensated for the value of the land as determined by a third party appraiser. So it isn't as if they're being booted out on the street - they usually get a fat check. Plus, they can challenge the condemnation in court.
I don't know all the details involved in this, but the only possible justification might be to remove urban decay and blight...but it still smells funny.

Big fight in Cincinnati over the same thing. Apparently an area with $90,000 homes is "blighted" according to city government. Houses taken, land given to developers. With this ruling, there is no more challenging the eminent domain decisions.

Local government has always been able to use immenent domain proceedings to obtain land for public improvements like highways, water towers, parks, etc. What grabs my attention is that the improvements proposed in Connecticut are PRIVATE improvements. How can a municipality act as a governing agency in the interest of their constituents, AND as a real estate developer without having conflicting interests? This makes no sense!
One thing with immenent domin is that the parties that own the land being condemned are compensated for the value of the land as determined by a third party appraiser. So it isn't as if they're being booted out on the street - they usually get a fat check. Plus, they can challenge the condemnation in court.
I don't know all the details involved in this, but the only possible justification might be to remove urban decay and blight...but it still smells funny.

The single largest increase in the size and scope of government in the last 25 years came under "conservative" rule. That would be Homeland Security, and it is hopelessly ineffective, inefficient, and un-American. Go conservatives!
