When I paid my 200 dollars to create a user account on Ubersite, I... oh, wait.
Ubersite is completely free, and has been for its entire existence. For years, it operated as nothing but a complete sink on bart's pockets, and even now with the uberboard and google ads it basically only covers its own existence.
The point is that like everyone else here, bart has a day job. Actually, bart's day job is a lot different than that of many people posting here because it actually keeps him so busy he never posts or replies on Ubersite during the day. He's also got a girl, and friends, and a life, which I guess also makes him fairly different from a lot of the regular Ubersite contributors, but for the sake of this argument try to understand.
Whatever contributions bart makes to ubersite, be it code upgrades, posts, or dealing with the Secret Service, are done at night and on his own time.
As a matter of fact, if it weren't for the fact that a very small minority of people here continually force bart to burn his time dealing with the messes they make, I'm sure bart would have seriously upgraded ubersite by now, after curing cancer and beating Chuck Norris in hand to hand combat.
All through the years that he's been operating this site, he's had to deal with a slew of letters from lawyers (including the *real* guy behind the Jew Toast pictures, growingfamily, and a lot of other hassles that come from you guys), he's had to deal with denial of service attacks, he's had to deal with automated scripting assaults, he's had to deal with users who like to try to find holes in his code by URL manipulation, the list goes on and on.
In all this time, he's dealt with these things essentially without complaint... when IHaveAKristenFetish was doing his damndest to actually bring Ubersite to its knees, and trust me I'm aware of the guy's skill level and say what you want about him, he knows his way around a computer, bart didn't so much as whimper to the Uber community.
For years he's sat around cleaning up our messes and has gotten nothing tangible or material in return, and it's time people got a little greatful.
Brad, and others who are in agreement with him, remind me of spoiled teenagers who wonder why their parents finally draw the line when they wreck their fourth car in nine months after getting their driver's license and then get arrested for possession.
You know, back in the day on Uber, I wrote a post entitled "F.A.Q.". The entire contents of the post read "Yeah, I said it. Fuck you!"
Go look it up in my history. You won't find it. Why? bart deleted it. He pooped on my right to free speech, because he thought it was stupid.
That's right, I am the only person as far as I know in the history of Uber to have a post deleted by bart on general principles of no worthwhile content.
Did I sit around and complain? Did I write post after post decrying Bart as a pussy and the coming of Red China?
No, I sucked it up and moved on. After all, he's providing a free fun service and it's his site, and if he wants to delete a post he can delete a post.
Show me anywhere on this site where there's a terms of service agreement where bart agrees to defend your right to... anything.
As far as I'm concerned, our "right" to post anything we want ends metaphorically at bart's face. If you post something that causes the guy grief, that sucks up his Saturday night or Sunday morning forcing him to go look up free speech laws on Stanford's website or entertain men in black suits in his underwear (well, actually he may enjoy that) then don't expect him to have your back... you haven't earned him having your back in any way, you're not his friend, in fact you're directly fucking with this guy's life and he is actually so angelic a dude that he'll sit around and actually entertain your arguments and respond rather than doing what I'd do... which is delete your account, ban your ip address, and email you a picture of Johnny Knoxville getting a colonic wearing a Santa suit.
If you want to have some website where people can talk about killing the president, and they pay for the full rights to free speech as defended by the webmaster, then go right ahead and make it. You can be just like pulsehead and sit in the corner with your five users and mutually masturbate over your superiority while wondering why more people from ubersite don't show up.
In the meantime, I am going to continue to use this free and fun service, and enjoy the community that exists around it, and do my absolute best to be a force for positive contributions, rather than be a pain in the ass and a drain not only on Ubersite's main resource, but also a drain on the personal life of a really nice guy who wastes his life for a bunch of thankless bitches.

Also, I'm not totally against making money on Ubersite, I would just rather do it on my own terms. In particular, I am not pleased with the ads on the site and will probably take them off. I would like to sell T-shirts, coffee cups, stickers, and Phinch thongs, but I don't want to go through Cafepress as they mark everything up about 10x reality so there's no money left to be made by the person actually making and selling the stuff, ie. me. I would rather not sell shirts then give Cafepress $15 a pop for printing them, so that's where we are now.

I know a few wholesale distirbuters who do shirts/coffe mugs/stuff like that.
They do our branded stuff for the hotel, they don't mark up a lot, and they do some decent bulk discounts from time to time. I don't think they do things like bumper stickers or stuff like that, but I can chat with the sales rep next time I put in an order and find out if they do, or if they deal with another company that does.

IHAKF was a great chapter in Ubersite history. What Bart left out was Caulaincourt and myself loading up the internet with references of his stalking/child molesting past which lead to his name being associated with being a rapist and thief.
Ah, I remember taking the fight off ubersite to other message boards in the hopes that someone would recognize his ugly mug as he walked through the corridors of Old Dominion and ram their fist through his jaw. By the way, this would merely shatter all the bones that individuals hand.
Is there a definitive history of IHAKF post? What always struck me as odd was the fellow named himself after another ubersite user (Kristen) which makes me wonder what his previous user name was. Or did he just see a photo of Kristen (Was she real?) when he first logged on and began the stalking right from there?
Those were good times.

Clearly the Abba song is infringement, but I have a feeling a court of law would accept the argument of educational/artistic fair use with respect to the animated gif.
Previous decisions have vindicated the use of copyrighted pics for use as avatars because of the poor quality and the subsequent impediment on the images' reproduction. The same sort of argument can be made in the case of the animated gif.
If we're going strictly by the law, we get the following argument...
In determining whether the use made of a
work in any particular case is a fair use the factors to be considered shall include—
(1) the purpose and character of the use, including whether such use is of a
commercial nature or is for nonprofit educational purposes;
[I make no money from my website. The works presented are done so not for redistribution, but for artistic and aesthetic purposes only.]
(2) the nature of the copyrighted work; [Artistic collage/technical montage/social commentary]
(3) the amount and substantiality of the portion used in relation to the copyrighted

I'm not afraid of lawyers and I have ignored or rejected plenty of take down requests in the past. In this particular case, I agreed that the posted photos were copyrighted by them and that legally I was obligated to take them down. I did not HAVE to take them down and they probably wouldn't have actually sued me, but the point was that I felt that I had a moral responsibility to take them down because the photos were clearly posted without permission of the people who owned them.
So was I threated with a lawsuit? No. Would they have sued me if I didn't take the pictures down? Realistically, probably not. If they had sued me, would I have been willing to get a lawyer and file paperwork and go to court to defend someone else's right to post someone else's baby photos without permission, add some captions next to them, and then say with a straight face that I thought this was "satire", not a derivative work, and that they should be exempt from copyright law as "Fair Use"? No.
Obviously there are billions of things posted here that are photos or pictures copied from someplace else. While I've tried to discourage this practice over time by emphasizing things like "Original Submissions" and such, it still happens. I decided that it would be presumptuous of me to take things down without knowing whether or not the copyright owner cared. So, I no longer consider it my responsibility to take something down proactively unless it's something super famous like the full text of a Harry Potter book (yes, this has happened) or unless someone can demonstrate that they are the original copyright owner and that they want the material taken off of Ubersite.
As far as Jeremy's "faq" post, I had totally forgotten about that. There was a time when I would try to take down really stupid posts, but clearly that time has long since passed. The good news is that the post was not "deleted", it was just taken off the site. It's still available, at least to me, at http://www.ubersite.com/m/4832 . Not very exciting.
This has been said, but Jeremy was definitely more offended by Pulsehead than I was. However, I never said anything like "Every good idea evolves and is improved upon", at least not in relation to PH. That would imply that I thought it was better than Ubersite, which I don't. I don't think Ubersite is perfect and there are all kinds of things that would make it better, and I don't claim to have invented the concept of a website where people can post stuff. What I do take credit for is the idea of creating a website with no purpose whatsoever other than its own being. Ubersite has never been about any specific topic or even about "good stuff" in any absolute sense. It has always been about the will of the people who were engaged with the site at any given point in time.
Also, not sure if you were kidding, but I never got any letter from the real Jewtoast, at least not that I remember. Am I forgetting something?
On Electro, I think the kid's got skills. He puts himself out there with things he likes to do that no one else would have done, and he's resilient in the face of criticism, no matter how mean spirited it is.

I Have A Kristen Fetish - holy shit. The one person on Ubersite that I would not want to see at my door. Very smart guy, very angry, and ready to snap at any moment. When you hear about people who go to work one day and gun down seven coworkers before they pop a bullet into their own mouth, those people are more stable than IHAKF.
The gist of it is that I think AJ framed him by automating something to drive up the hit counters on his posts. I responded by hard coding all of his posts to have zero hits. He responded by launching a distributed denial of service attack against ubersite from something like 1200 different computers, all constantly drilling the site driving up hit counts on his posts. I responded to that by stalking all the posts he made, finding his personal website, geolocating his IP address, and then updating all of his information on his Ubersite account with his real personal information including full name, city, and state. He then declared me his archnemesis and vowed never to give up until he destroyed ubersite and then Jeremy managed to talk him off the ledge and things got back to normal somewhat. I let him do all kinds of shit after that and then once he moved on to become obsessed with Lojope and then I banned him. I'm sure he could have gotten around that, but as far as I know, I haven't heard from him since.
Lot of water under that bridge. And the bridge has since collapsed.

Oh...my idea of pulsehead and such...if Bart was to simply add a couple lines of code to allow bold and italics in the body of text on a post...Pulsehead would be dropped down yet another notch. I think most of the real writers here would all agree that they'd love to have italics available to stress words.

I'd love to hear about the real Jewtoast incident.
I give Bart major props for the site which has attracted all types. I know he is busy and all, but it would be nice to see a little upgrade or updating to keep the site fresh. Keeping posts off the front page that drop below -1 after X number of reviews is exactly the thing that keeps the site fresh.
We can all wish for the day Bart gets dumped by his girlfriend and fired so he can concentrate more on ubersite.
Wait. Maybe that isn't nice to wish for.

Razor, really, I agree with the overall message here, but that was an unnecessary potshot. I thought that the hatchet was buried. Nobody here has said really anything about pulseHEAD for quite some time.
I think bart will agree, he didn't really invent the idea of a web forum. There were (and are) some rather innovative things here, but people act like it's the most original fucking thing in the world since Spaghetti-Os. I saw some stuff here that I liked, I saw some things that I didn't. I thought I could improve on the concept.
I didn't try to "steal all his users" either, that's totally incorrect. A bunch of people on this site ASKED for the changes, I decided that I could provide them. End of story. I announced the site here, I didn't tell people to quit ubersite and come to pulseHEAD, I suggested a coexistence.
bart has told me that he doesn't care that I started pulseHEAD on several occasions. Besides, it only gets like 2% of the traffic that ubersite does.
I honestly don't care if another single Ubersite user comes to pulseHEAD. I think both of the sites have their values. If you like pulseHEAD, try it. If you don't, stay here. Have accounts on both. I just provide the service.
I would take Electro if you guys sent him over though.

A fair question... The answer is, no one is saying he HAS to.
It depends entirely on how much one is willing to fight for a cause. As you probably know by now, I have causes coming out the ears. Some would rather take the easy road and get out with as little resistence as possble, which I totally understand, but everyone has to understand that the more we do this, just as a collective, the more our individual rights will dwindle, because there's ALWAYS someone out there who will be more than willing to push you around if you won't stand up for yourself.
Mine and Bart's 'debate' - if you could even call it that - centered purely around the semantics of the law. I do not question Bart's willingness to stand up for his/our rights in the larger scheme. I just think he's misinformed about what, exactly, those rights ARE. Of course, he'll say the same thing about me, hence the 'debate'.

gascs and I made our peace over PH a long time ago, and I probably shouldn't have included that dig at ph in this post, because it was irrelevant to my overall message. I just was making the point that if you really don't want to play by uber's rules, go do your own thing... I just don't think it's going to be a success.

The issue for me Razor,is that you seem to take more of an issue with it than El Barto does. In fact he never had an issue with it.
I believe his response was along the lines of " Every good idea evolves and is improved upon. "
Whatever your thoughts are on whether it has improved the idea or not, is down to personal opinion, something I wouldn't pull you up on.
There are things I prefer about Pulse and equally, things I prefer about Uber.

Um, hate to break the news to you Razor, but there was never any "Stealing" of users. It's not like you can only post on one site or the other. Hell, I heard about pH FIRST, then Uber a few months later. Yahoo, MSN and AOL all have IM programs, there are how many search engine sites? Why does it matter if there is another place somewhat like Uber? Variety, brother... that's all it is.
Besides, it's not as if pH drags away hundreds of users from Uber. It's a totally different kinda site, that's why many people here don't care for it.

But I don't know about that pulsehead thing though. I also don't know why people would be too upset about it. It all seems pretty mediocre to me. Maybe I'm just an unusually assholish person by nature, but say I wrote a book with some revolutionary ideas, and then some dick, AFTER IT WAS PUBLISHED, wrote it in a much more mediocre way and got all of 5 people to buy it, I don't think I'd be out all that much.

That history of Ubersite post actually leaves off a lot of stuff that IHAKF did, or tried to do, which I think bart actually just never told uber about.
He ran scripts to create denial of service attacks, he punctured uber's security in a few places and put up posts detailing how to do it, he threatened bart over email in a lot of ridiculous ways, all sorts of things.

I LOVE this website, and I have endless respect for Bart Cilfone for making this place possible. It is a BASTIAN of free speech on the internet... One of the very FEW out there, in fact.
I just a) do not enjoy being treated like a child, or b) having my arguments inadequately addressed in a debate when I think I've made a pretty compelling argument.
It's a matter of pride and, YES KAOS_KING, it is a fault of mine.

I'm sorry, but no they didn't. I saw a bunch of people eager to see ol' ETS pwned by someone...ANYONE...and I saw a lot of sycophantic people jump to the conclusion that that pwnage actually took place, but the fact is, there was no such pwnage on that post.
The fact is, this cannot possibly be settled outside a court of law. That's why we HAVE courts, so arguments like this can be carried out in a structured forum (hopefully) without the kind of prejudice that exists in everyday life (aka places like ubersite).

I made my respect for Bart more than clear a number of times on this website. What pissed me off wasn't that Bart didn't do more to resist the scare tactics of growingfamilies (which was really my ONLY beef in that entire SS/coyright incident), it was that when I suggested that, had Bart felt so inclined to fight back, he would have had a case, I not only got shot down, I got kicked in the stomach and spit on in the process by being treated like a fucking child, which, of course, I did not and DO not appreciate.
No one is questioning Bart's autonomy in controlling his own fucking website. You've totally misunderstood the issue. Well, on second thought, no you haven't... What you've done is taken a hot-button topic and decided to get in on the action.
Fair play to you, but it doesn't mean you automatically know what the fuck you're talking about.

Yeah, he's a cool guy, but he is the authoritarian figure on this website. People either kiss his ass or rebel against him. It's just human nature. We all know Bart devotes a lot of time and energy into something that is essentially costing him time and energy and giving him nothing back.
He actually gave me a long, detailed reply when I said something in his post about somethingawful constantly getting legal action taken against them, and never caving, which I was just kidding about (about him being a pussy). When customs agents came to my door and told me I was about to go to prison for five years for importing bootleg DVD's from china, I promptly told them the name of my friend who was having them sent over to my house. I even said I would go over there with them so I could punch the dude in the face, so trust me, I know there are a lot of things that aren't against the law BUT THAT STILL MIGHT FUCK UP YOUR LIFE. And I don't blame anyone for not wanting to make some pointless "stand" or whatever.

If I were to do it, it sure as hell wouldn't be with this, because this would never make it to the Supreme Court.
