Over the past week, I actually hit a new low. The worst thought that can ever enter a person's mind is "life can't get any worse." Well, actually, yes it can. Over the past year I've battled a collapsed lung, pneumonia, a collapsed disc, a herniated disc, anemia, GI bleeds, and most recently bone marrow issues. I sit back and laugh at those obstacles now. Last Tuesday an event took place that has changed my life and left me in a state of such pissed offness that I am seriously glad I do not own a gun.
On Tuesday morning I was taken to jail. The charge, reckless driving. The speed, a blazing 6mph. Yes folks, that's not a typo, 6 mph. I have done a lot of stupid shit in my life. I remember times driving 120mph, experimenting with drugs, and getting into stupid fights. I've matured a lot. Imagine my surprise when I found my self in jail on Tuesday, all dressed for work in shirt and tie. Here is the story. I will not confess complete innocence, I'm not a fool after all.
As I was leaving for work on Tuesday morning I came across a school bus coming from the opposite direction. It stopped, so did I. I little girl with black hair, who come to think of it might be a witness now, crossed in front of me and got on the bus. I waited. I saw her sit down inside the bus. I waited. The bus driver turned around and started yelling at the kids on the bus. I waited some more. Then I looked around. There were no kids, I looked again, no kids. Two minutes passed. I simply let my foot off the brake and coasted by the bus at idling speed, not more than 6 mph. I continued to look around to make sure there were no kids, and there was not. I proceeded past the bus and on my way to work.
Now, where I live we have our own rent a cops, only now they have real badges. So they are really gung-ho asshole motherfuckers, if you know what I mean. I get to the bottom of the hill and get pulled over by said asshole. Did I mention I knew this particular asshole. He came up to my car and asked for my license and registration. I confusedly gave it to him. He came back and asked if I had seen a school bus on such and such a road. I said well yeah I see that school bus everyday. This is when life really started to suck.
He tells me to get out of the car. I ask why. He says I've committed a Class B misdemeanor and he is taking me to jail. I reply "you've gotta be fucking kidding me". Well he wasn't. Asshole put the cuffs on me then and there and took me straight to jail. Booking time. This part was fun. I had to tell the Booking Officer my offense. By the way, the real cops hate these fuckers too. She says that I should be out in couple of hours. Okay, not too bad. Then she says, uh oh, you have a failure to appear in court. She then asks me what the original charge is. As god is my witness, it's a seat belt violation. I had forgotten about it until they threatened to suspend my license, so I promptly went down and paid my 25 dollar ticket. This means that I now have to go before the judge. This cant happen until dickless turns in his police report. Which he decides he isn't going to do until after court is over for the day.
So I got to spend a lovely 28 hrs in the drunk tank with 3 DUI's, an FBI federal fugitive, an armed robber and some other pleasant individuals. Not my most shining moment. Jail food sucks by the way. They dressed me in an orange jump suit and wouldn't even allow me to keep my underwear or my socks on. Fuck it was cold in there. I was denied my medications, which really sucked. Later in the evening I decided I would have to call my parents to at least let them know what happened. They refused the call, I found out later it was accident, wrong button. So my life pretty much is sucking pretty bad at that point. Finally I get to see the judge. I get shackled hand and foot. And led in to the courtroom where my whole family is sitting there in a kind of amused horror.
This bitch of judge sets my bond at 500 dollars. I would have been better off getting a DUI or a drug charge. 2 hrs Later and I'm out on bond and talking to my lawyer. Thank god for my lawyer. He's more pissed off than I am. I find out than an officer cant arrest me if he doesn't view that particular crime. I should have received my license back immediately after I pled not guilty. There was no reason to spend 27 hrs in the drunk tank and the fact that they denied me my medications is negligence. I'll let him work it out. However I did tell him if he gets the charges dropped we are definitely suing my subdivision and that asshole. Whatever the cost.
6mph, what a dick.

I reread that JoeDaddy, hmmm we'll see. I wonder why though, the FTA was never mentioned in court. Neither the judge or the prosecutor said anything about it, even when bail was being set. 500 dollars is the standard amount in Indiana, or the minimum, you might say. My lawyer said that everything would be wrapped up by then end of this week and that I would have my license back. Which would imply all charges dropped.

The only thing the FTA did was was get rid of my ability to get an OR bond, instead I had to go in front of the judge and get a bail set. I was pissed because it was over a seatbelt violation. However, It has no bearing on the officers assumption and arrest, which was illegal. As far as the FTA is concerned it has no more bearing in future proceedings, unless I were to miss another one, which I will not.

it doesn't matter that you paid the fine
it doesn't matter that some clerk failed to remove it
it doesn't matter that the arrest was based on something else

ex.
My friend Bill and I were driving back from buying some killer buds. We of course were blazed, and I got pulled over by a cop. He pulled us over because he said my bumper was above allowable tolerances (BS that you'll always get when you have 33" tires, even though you installed a street legal lift kit and passed a Maryland State Inspection). Anywho, this same cop had attempted to aprehend us on an earlier occasion when we were smoking a blunt in a park, only problem was we were 19 and he was about 100 lbs overweight.
So he thought he had us.
And he demanded that we step out of the vehicle and let him search it.
But I knew he had no right to search my vehicle for the reason he pulled me over, even though I did have a ounce of weed hidden inside.
When I refused him and informed him he'd need a warrant, he got understandably pissed.
So he tries to tell me that I'll have to wait until he can secure a warrant.
This again is bullshit, and I told him that he can't detain me for no reason, which he can't (intuition isn't a reason).
He tried talking some shit, and I made like a smartass repeating his badge number and name aloud, telling him I was memorizing it for a formal complaint and possible lawsuit.
It's actually quite fun to fuck with the pigs.

First off JoeDaddy, the only thing I would sue is for the actual act of the officer arresting me. Indiana law states that the officer must observe the infraction for him to arrest you. He did not, he took the word of the bus driver, which was illegal and here say. The wanna be cop later told his partner what happened in his own words. When my father went down to pick up the truck he had to get the keys from the partner. His partner said I was in jail because I was behind the bus and sped around it ignoring the extended stop sign at 40 mph. Neither officer even knows the facts of the case, and this is why you arent allowed to arrest unless you view the accident with your own eyes. I fully believe that if he had witnessed the infraction he would given a lesser offense payable by ticket, which I would have complied with, or a verbal warning.
As for the failure to appear. My mistake. I got the seatbelt violation on the one day I had out of the hospital in between tests. I was never sent anything else about it until the notice of suspension on my license, at which point I went down and paid my whopper 25 dollar ticket. If you cant see a difference between an FTA on seatbelt violation as opposed to something really serious like felony robbery, or something to that effect, then you're a moron. Also I was not arrested because of the FTA, the simple bench warrant for my arrest was rescinded the moment I paid my 25 dollar ticket. Fact of the matter is I am not a flight risk. I've lived at the same address for 21 yrs, worked in the same area for the last 13 yrs and my extensive medical problems would neither allow me to travel quickly nor easily. All of which could be easily seen from my file.

you're not going to win anything because the FTA is a seperate and arrestable offence
it makes no difference if it's from an infraction, misdemeanor, or a felony
it also makes no difference as to who brings you back to the court because the judge will accept your "body" back in court from anyone
do you actually think anyone would "cite you out", once again, when you have already proven
your inability to show up?...i think not

to the author of this post- you got fucked bigtime. SUE SUE SUE. oh, and read up on the law as much as possible so that the next time this happens, you'll have the knowledge to tell the cop he's wrong and he might reconsider arresting you. probably not, but there's a slim chance.

i can seriously sympathize with your case. In the last year my innocence was raped by a parking fine of 65 euro's and a not-wearing-seatbelt (which is was putting on, and ALWAYS do (it's my safety)) 45 euro's. And a speeding ticket. 60 euro's. I did an insane 4 miles over the limit.
Ridiculous, i agree. Maybe i should've been guillotined for it..

I don't recognize rent-a-cops as actual law enforcement. Therfore I don't acknowledge thier right to pull me over. One of my buddies used to live in a subdivison with those pricks.... they only had a couple, there was one dude we really didn't like. Unfortunately, I'm gonna be a pain in the ass here and say that I totally can understand pulling you over for passing that bus. I realize you looked around and shit and drove slow but I know they have to draw the line somewhere as far as when you can and can't pass the bus, 6 mph or not...you don't wanna end up with some darting little susie under your wheels, do you? well maybe you do.
Anyhow I would think a warning or maybe even a ticket would have been understandable..but arrest? and stuck for over 24 hours? goddamn your week sucked about as much as mine.
